Charges DISMISSED in the Dave Chappelle banana peel incident...

Though the Comedian believed fruit peel attack was racially motivated!
On Friday morning, The Albuquerque Journal reported that prosecutors dismissed misdemeanor battery and disturbing the peace charges against 31-year-old Christian Englander after Chappelle was unresponsive to requests for testimony. The comedian has previously said the March incident in Santa Fe, New Mexico was a racist act.
Christian Englander, 30 was arrested on suspicion of disorderly conduct and battery during Chapelle's show in New Mexico after he reportedly threw the banana peel at the comedian back in March.
Koko: Now that was really ignorant.

Christian Englander later threw another banana peel at a second black man just two days after insisting that too was also a joke!
Melly: REALLY??? Twice?See now THAT's a habit.
MJ: Twice makes it a habit?
Melly: Yup! It's a habit!
Bliss: That mugshot tho.
'I'm sorry that my joke was misconstrued as a racial attack on Dave Chappelle,' he told The Albuquerque Journal. The second, he threw because the 'irony of this situation is too much to pass up'.
Koko: Ok the first one...welllll...but that part about it being "too good to pass up" really annoys me.
MJ: I know...sounds childish.

If Englander fails to perform 22 hours of community service by Feb. 16 under the conditions of the dismissal, charges can be refiled.
Police did state the 30-year-old, from Santa Fe, appeared to be drunk as he sat near the stage.
